What Does an Appellate Lawyer Do And How Can They Help in My Case?

Appellate practice is a specialized discipline requiring the appellate lawyer to correctly diagnose the problems at trial and present those problems clearly, intelligently, and creatively to the appellate court. The appellate lawyer must also identify and apply the correct standard of review to the facts and law of each case.

To be successful on appeal, it is important to craft and execute the most effective strategy that both identifies the flaws that led to the unjust result you are appealing and presents your case in the most persuasive light possible. Such a strategy requires an in-depth understanding of how appellate courts review the merits of a case, apply various forms of authority, and make decisions that may ultimately become binding precedent.

An appellate lawyer has the advantage of reviewing your case with fresh eyes, In doing so, the appellate lawyer is able to target the arguments that the appellate court is most likely to be concerned with, and present those arguments in the strongest possible light.
